Long Term Care 

DSED represents and advises long term care providers in appeals of administrative and civil monetary penalties, Medicaid/Medicare terminations, resource utilization audits, license denials and revocations, Medicaid fraud and recoupment matters, and defense of actions brought by the Texas Attorney General’s Office. We also advise clients on regulatory compliance and licensure matters, changes of ownership, due diligence and property rights.  Our clients include nursing facilities, assisted living facilities, intermediate care facilities, and home health agencies.  


 

Professional license defense 

DSED lawyers have a combined 45 years of representing licensed health care professionals. Our lawyers represent and advise Physicians, Physician Assistants, Dentists, Nurses (Advanced Practice, Registered Nurses and Licensed Vocational Nurses), Pharmacists and Pharmacies, Psychologists, and other Mental Health professionals (such as Licensed Professional Counselors, Licensed Marriage and Family Therapists, Social Workers, Licensed Chemical Dependency Counselors and Licensed Sex Offender Treatment Providers).

We regularly assist clients with responding to licensing board complaints and investigations, and we appear with clients at Informal Settlement Conferences, Ethics and Committee meetings, and in contested cases before the State Office of Administrative Hearings (SOAH). DSED lawyers also assist their clients with complying with administrative regulations, implementation of best practices, HIPAA compliance (including breach notification and risk assessments), compliance with disciplinary requirements, and development of plans of correction.
